An analysis of the challenges for the provision of the legal service

Abstract

The difficulties faced by citizens in accessing justice are multifaceted, overcoming the strictly legal perspective. In this sense, the study of effective jurisdictional provision must take a multidisciplinary approach. Based on the assumptions that support the agency's theories and transaction costs, Akutsu and Guimarães (2015) highlighted the need for studies that analyze judicial governance based on accountability; accessibility; independence; resources and structure; governance practices; institutional environment and performance. Considering the categories listed by this theoretical-methodological model, a study was carried out that aimed to investigate judicial governance based on research carried out in the Federal Court, the Regional Electoral Court and the Regional Labor Court in Rio Grande do Norte. To this end, questionnaires were applied with public servants from these institutions, which attributed scores to the items that make up the judicial governance according to Akutsu and Guimarães (2015). In the end, it was possible to study the level of governance and analyze the challenges present in the provision of the judicial service.

Raquel Maria da Costa Silveira, Federal University of Rio Grande do Norte

Full Professor at the Department of Public Policy at the Federal University of Rio Grande do Norte (UFRN). Coordinator of the Natal Nucleus of the INCT Observatório das Metrópoles: territory, social cohesion and democratic governance, network research involving comparative studies on 15 Brazilian metropolises. Sociologist and Economist. PhD in Economics from the State University of Campinas (Unicamp). Post-doctorate at Université Lumiére, Lyon). CNPq Research Productivity Scholarship, Level B1. She is the author of books and articles on urban and regional studies and the economy of Rio Grande do Norte.

Lindijane de Souza Bento Almeida, Federal University of Rio Grande do Norte

Graduated in Social Sciences (1998), with a degree in Sociology and Political Science, from the Federal University of Rio Grande do Norte, master's (2001) and doctorate (2006) in Social Sciences from the Federal University of Rio Grande do Norte, in the area of Regional Development concentration. From January 2019, she is an Associate Professor II of the Department of Public Policy at the Federal University of Rio Grande do Norte, working on the undergraduate course in Public Policy Management and the Postgraduate Program in Urban and Regional Studies. He has experience in Sociology and Political Science, researching mainly the following themes: state, democracy, participation, public management, public policies and citizenship. She is currently Head of the Department of Public Policy, researcher at the INCT- Observatório das Metrópoles Núcleo Natal, leader of the State and Public Policy Research Group at UFRN, Advisor to the Board of Curators (CONCURA) at UFRN, at the Deliberative Council of Fundação Norte- Rio Grande do Sul Research and Culture (FUNPEC) and the Advisory Council of the National Association for Teaching and Research of the Public Field.
